Documentation

We would like you to know the steps, documents and processes involved in buying your next “The One” vehicle:

1. Pre-Order: The first step will ask you to sign the “Pre-Order Terms and Conditions” document (you are currently reading it) together with a Pre-Order Fee payment (100€, or equivalent for non-european customers).
2. Vehicle Customization: The second step will guide you through the amazing process of personalizing your unique The One. It will include pricing, but without taxes, government fees or shipping if applicable). You will sign the “My Bespoke The One” document.
3. Order Confirmation: Once the delivery date is near, the “My The One order Confirmation” document will be sent to you, including the final price of the vehicle including taxes, fees and shipping (if applicable).

Changes in Terms&Conditions

The Website and our business may change from time to time. As a result, at times it may be necessary for us to make changes to the Terms. Please review the Terms periodically, and especially before you order or pre-order any Products on the Website. We reserve the right to update or modify these Terms at any time and from time to time without prior notice, and such changes will apply to your purchase or pre-order transaction if you place such order after the date of last modification indicated above.

Effective Date

This Agreement is formed and becomes effective when we receive both your: (1) validly executed “Pre-Order Terms and Conditions” document, (2) Pre-Order Payment in the amount and form stated in the payment instructions provided to you in connection with this document.

By accepting this agreement, even in checkbox form through our website, you are accepting all the Terms & Conditions included in this document

Once this Agreement becomes effective, and the Pre-Order Payment is fullfilled, you will be placed on the pre-orders list and you will receive communications about the development of the “The One” vehicle (“Vehicle”)

Pre-Order

You confirm that you wish to have a priority to order a Vehicle once these are ready for sale.

You completely understand that we may not have completed the development of the Vehicle or begun manufacturing the Vehicle at the time of your Pre-Order.

You also understand that your Vehicle is configured at the time of your Pre-Order, and in case that future new options, features or configurations for the Vehicle are released, they may not be included or available for your Vehicle.

Non-Binding Pre-Order Payment

This Agreement does explicitly not constitute an agreement for the sale of a “Vehicle” and does not lock in pricing, a production slot, or an estimated delivery date. This Agreement doesn’t give you an obligation to purchase a “Vehicle” from us and doesn’t give us an obligation to produce the “Vehicle”.

Once we contact you for the Order Confirmation, such sale and purchase will be governed by a separate and legally binding purchase agreement between you and us or between you and another dealer which is authorized by us.

Pre-Order Price, Taxes and Fees

The pre-order price of the Vehicle will be confirmed in your “My Bespoke The One” and “My The One order Confirmation” documents. As you may have only configured part of your Vehicle, any pre-order price provided to you in advance of the “My The One order confirmation” is only a estimation and is subject to change.

The Pre-Order payment won’t be discounted from the final price.

Cancellation; Changes

The Pre-Order Payment is fully-refundable until the date you sign the “My The One order Confirmation” document.

Until your final configuration is matched to a vehicle, you may make changes to your Vehicle Configuration. If you make changes to the configuration of the Vehicle, you may be subject to potential price increases for any pricing adjustments made since your original Pre-Order Date. Any changes made by you to your Vehicle Configuration, including changes to the delivery location or estimated delivery date, will be reflected in a subsequent Vehicle Configuration that will form part of this Agreement.

Priority, Deferral and Non-Transferability

We will establish your Pre-Order sequence position in our sole discretion. We may decline pre-orders to avoid over-subscription, if we are unable to commence manufacturing or shipping of the Vehicle to your region or as we deem appropriate in our sole discretion. If your pre-order is declined, you will be notified and your pre-order payment will be refunded.

If you do not wish to enter into a purchase agreement at the time that we contact you with the “My The One order Confirmation”, you have the option to relinquish your pre-order sequence position and defer to a later position to be determined by us (only one deferral is permitted).

If you do not communicate your decision to us within seven (7) days of notification, you will automatically be granted such a deferral.

This Agreement is not transferable or assignable to another party without the prior written approval by us.

Delivery

In case you want your Vehicle delivered in a country or region where we are not licensed to sell, we will, on your behalf, manage the shipping of the Vehicle to you through a third party carrier. You agree that the delivery of the Vehicle, including the transfer of title and risk of loss to you, will occur at the same time your Vehicle is handed to the carrier company. The vehicle will be insured and you will be the beneficiary of any claims for damage or losses during the time the vehicle is in the possession of the carrier.

Limitation of Liability

To the maximum extent permitted by applicable law, we make no warranty of any kind in connection with this Agreement or its subject matter. Under no circumstances will we be held liable for any indirect or consequential loss or damage, including any and all (a) loss of opportunity (including loss of contract or right to offer or tender); (b) lost opportunity cost; (c) loss of business; (d) reduction or damage to goodwill; (e) damage to name or reputation; (f) loss or corruption of data, and regardless of whether any or all of these circumstances are considered to be indirect or consequential losses or damage, in contract, tort (including negligence), under any statute or law or otherwise arising out of our breach of this Agreement, even if we have been advised of the possibility of occurrences which would or might lead to such loss or damages. If we are held liable for any damages related to your pre-order or this Agreement, your sole and exclusive remedy will be limited to reimbursement of the pre-order payment paid to us.
